Booking Terms

1.Who you are contracting with

Slavica Svilar, Kotorska 54, 51260 Crikvenica, Croatia Registered private renter, trading as Apartments Gloria info@kotorska54.com · +385 99 222 1451

Your contract for the stay is with her. Booking.com and any other platform you may have used are intermediaries; they are not your host and they do not own the apartment.

A booking exists when we confirm it, not when you request it. The confirmation states the apartment, the dates, the number of guests and the price, and it is those details that bind both sides.

2.What you are booking

You book a whole self-catering apartment for a stated number of guests, not a room in it. The apartment is yours for the dates confirmed and nobody else is placed in it.

The number of guests on the confirmation is part of the contract. It is what the price was calculated on, what the property is registered for, and what we are legally required to report.

If more people arrive than the confirmation states, there are two cases and the line between them is not our preference:

  • Within the apartment's registered maximum — we charge for the additional guests at the rates below and everyone stays.
  • Beyond the registered maximum — we cannot accommodate them. Each apartment is registered for a maximum number of people and we are not permitted to exceed it, whatever we might think of the party at the door.

Tell us in advance either way. A change is easy; a doorstep conversation is not.

Children of any age are welcome. A child aged three or over counts as a guest and is charged as one. One infant per apartment does not count towards the guest number.

3.Price, extras and taxes

ItemCharge
AccommodationAs confirmed, per night, for the apartment
Fifth guest, two-bedroom apartments+25%
Extra bed€15
Cot, ages 0–2Free
Pets€10 per pet per night, at most two per apartment, by prior agreement
Tourist taxPer person per night, at the statutory Crikvenica rate, payable for nights actually stayed

Prices are in euro and include bed linen, towels, utilities and the final clean. Tourist tax (boravišna pristojba) is set by law, not by us; we collect it and pay it on.

4.Payment, and the card we hold

Booking directly, you pay in two steps. 30% of the stay at booking — the akontacija — and the remaining 70% thirty days before arrival, charged automatically to the same card. A booking made inside 30 days is payable in full at booking. Direct rates are 15% below the Booking.com price in exchange for these firmer terms.

If the balance cannot be charged, we email you a secure payment link, to be paid by 26 days before arrival, and then a reminder with a final date 23 days before arrival. If it is still unpaid after that, we may cancel the booking, and the 30% paid at booking is then not refunded.

Where you booked through Booking.com, that channel's payment terms govern instead.

We also accept cash for the balance and for extras, and we intend to keep accepting it — some guests arrive with the stay in cash, others with a card and fifty euro in their pocket, and neither should be turned away. Card payments are processed by Stripe; we never see or store your full card number.

The card on file. When you book directly with us you give us card details, which are stored by Stripe as a token against your booking.

By giving us your card details you authorise us to charge that card, without asking you again, for: 1. the accommodation charge when it falls due — the 30% at booking and the 70% thirty days before arrival; 2. any amount payable under the Cancellation and Refund Policy, including the no-show charge; 3. damage or loss for which you are liable under §5, up to the amount pre-authorised; 4. unpaid extras — tourist tax, an extra bed, a pet charge, or an extra guest. We will email you before making any charge under points 2, 3 or 4, stating the amount, what it is for, and the clause it is made under. You keep every right to dispute it with us and with your bank.

That notice is not a formality. A charge you did not expect is a charge you will dispute, and we would rather explain it than argue about it afterwards.

Where you booked through Booking.com, this section does not apply — Booking.com's own payment terms govern, and any charge is collected the way Booking.com collects it.

5.Damage

You are responsible for the apartment while you have it, and for everyone staying with you. That means damage beyond ordinary wear, items missing at check-out, and the cost of making good — but not the small accidents that are simply part of people living somewhere. A broken glass is not damage. A broken door is.

Pre-authorisation. When you arrive, we place a pre-authorisation of €150 on your card. Never before then, and never as part of paying for the stay. The same amount applies to every booking, whichever channel you booked through — there is no list of guests we trust more and no judgement made about you at the door.

A pre-authorisation is a hold, not a payment. The amount is reserved by your bank and no money leaves your account. It is released after check-out once the apartment has been seen, and in any case within seven days. If we find damage, we tell you what it is and what it costs before we charge anything against it.

Where the cost exceeds the amount held, you remain liable for the difference. Where we charge you, you can ask for photographs and, where work was done, the invoice — and we will provide them.

Report damage. If something breaks, tell us. Damage reported honestly is handled reasonably. Damage found after you have gone is handled by the paragraphs above.

6.Arrival, departure and registration

Check-in 14:00–23:00. Check-out 07:00–10:00. Tell us your arrival time; tell us as soon as you know if it will change.

We are required by law to register every guest with the Croatian eVisitor system, including children. You must present a valid passport or identity card for each guest on arrival. This is a statutory obligation on the host, not a preference of ours, and we cannot accommodate a guest who cannot be registered. What is collected and why is set out in the Guest Privacy Notice.

The lead guest must be at least 18. Guests under 18 are very welcome, with an adult on the booking who is present for the stay.

Maximum stay is 90 nights, an eVisitor limit.

7.House rules

The apartments sit in a building with neighbours and other guests, and the rules exist for them as much as for us.

  • No smoking. Smoking is not allowed at the property.
  • Quiet hours 23:00 to 09:00. Croatian law protects night-time quiet and neighbours enforce it.
  • No parties or events, and no hen, stag or similar parties. The apartments are let for accommodation, not for functions.
  • Pets are welcome by prior agreement, at the pet charge in §3.
  • Only the guests on the confirmation may stay overnight.
  • Tell us your expected arrival time before you travel.

These are the rules published on our listing. They are the same rules wherever you booked.

Serious or repeated breach entitles us to end the stay. That is a last resort and has never yet been needed; where it happens, the remaining nights are not refunded.

8.Cancellation

Set out in full in the Cancellation and Refund Policy, which forms part of these terms.

On a direct booking there is no free-cancellation window. Cancel before 30 days and you lose the 30% akontacija and nothing more. Cancel inside 30 days, or fail to arrive, and the full amount is retained — though if we re-let the dates we refund whatever we recover. If your plans are not firm, book through Booking.com, where the policy is more forgiving.

On a Booking.com booking, that channel's own policy applies and nothing here changes it.

9.What we are responsible for

We are responsible for providing the apartment as described and in a fit state. Where we fail, you have the remedies Croatian consumer law gives you, and nothing here limits them.

We are not responsible for things genuinely outside our control — weather, a regional power or water failure, road closures, or a change in your circumstances. Take out travel insurance; it is cheaper than any of the outcomes it covers.

Your possessions are your own responsibility. The apartment has a lockable door and we ask you to use it.

10.If something is wrong

Tell us while you are here. Nearly everything can be fixed the same day if we know about it, and almost nothing can be fixed after you have gone home. Call +385 99 222 1451.

If we cannot resolve it, write to info@kotorska54.com. We will answer in writing within 15 days. An EU consumer may also use the European Commission's online dispute resolution platform.

11.Law and language

These terms are governed by Croatian law and the Croatian courts have jurisdiction.

These terms exist in Croatian and in English, both of equal standing. Where the two differ, the Croatian version prevails. Nothing in this clause removes a right that Croatian consumer law gives you regardless of which text you read.

Cancellation and Refund Policy

1.Which terms apply to you

It depends where you booked, and the difference is real.

Where you bookedWhich policy
Directly with us — our website, email, telephone§2 and §3 below
Booking.com or another platformThat platform's policy, as shown to you when you booked

We do not use this page to take away something a platform promised you. If the terms you were shown at the time of booking differ from these, the terms you were shown are the ones that apply.

2.Direct bookings: how payment works

Booking directly is 15% cheaper than the same dates on Booking.com. In exchange the terms are firmer, and you pay in two steps rather than all at once.

WhenWhat you pay
At booking30% of the stay — the akontacija
30 days before arrivalthe remaining 70%, charged automatically to the same card
Booking inside 30 daysthe full amount, at booking

The tourist tax is separate from all of this and is settled on arrival for the nights actually stayed.

We email you before the 30-day charge. If the card has expired or been replaced by then, tell us — we would far rather update it than cancel your stay, and we check for this weeks in advance precisely so it does not become a problem.

3.Direct bookings: if you cancel

There is no free-cancellation window. The akontacija is not refunded, whenever you cancel.

When you cancelWhat it costs you
Any time before 30 daysthe 30% akontacija; nothing else is due
Inside 30 days100%. Nothing is refunded
No-show100%. Nothing is refunded

Inside 30 days the balance has already been paid, and it is not returned. A stay cancelled at short notice is not re-sold: the median guest here books 95 days ahead, so a week given up a fortnight before arrival stays empty. The loss is the whole stay, and the charge reflects it rather than estimating it.

Why it works this way, plainly

We are three apartments with one selling season a year. A peak week cancelled in May is not re-sold in June — in 2026, 218 peak unit-nights were booked and then cancelled, and the cancellation rate was 60% against a local average of 36%. Every speculative booking that is later dropped occupies a week that a guest who actually intended to come could have had.

The akontacija is what makes a booking mean something. It is also why the direct price is 15% lower: you are giving us certainty, and we are paying you for it.

If your plans are not firm, book through Booking.com. That is not a sales trick — the policy there is more forgiving and we would rather you chose the terms that suit you than lose money you did not expect to lose.

Travel insurance covers this. A cancellation for a reason your policy accepts — illness, bereavement, a cancelled flight — is reimbursed to you, less whatever excess your insurer applies. We have no equivalent cover and cannot buy any; you can, for a few euro.

If we re-let the dates, you get that money back

If we do manage to re-let your apartment for some or all of the cancelled nights, we refund what we actually recover, less any difference in price and the cost of re-letting. We will not be paid twice for the same nights.

This is not generosity and it is not discretionary — it is what keeps the charge above a genuine pre-estimate of our loss rather than a penalty, which is the line Croatian and EU consumer law draws. If the loss disappears, so does the charge.

4.Leaving early

If you check out before the end of a booked stay, the remaining nights are not refunded. The nights were held for you and can rarely be re-sold at short notice.

5.If we cancel

We cancel a confirmed booking only if the apartment genuinely cannot be used — fire, flood, a failure of water or electricity we cannot repair in time, or a legal order. In that case you get **everything you have paid back, the akontacija included, with no fee of any kind**, and we will help you find comparable accommodation nearby. We do not cancel a confirmed booking because we could have sold the dates for more.

6.Refunds

A refund goes back by the same method you paid, to the same card or account. We start it within 14 days of accepting the cancellation. How long it then takes to appear is your bank's business rather than ours.

7.Tourist tax

Croatian tourist tax (boravišna pristojba) is payable per person per night actually stayed. It is never charged on a cancelled stay and never forms part of a cancellation charge. If it was collected in advance it is refunded in full.

8.No 14-day withdrawal right

EU consumer law gives a 14-day right of withdrawal on most distance contracts. Accommodation booked for specific dates is excluded from it — Art. 16(l) of Directive 2011/83/EU, as applied in Croatia. Your rights on cancellation are those set out above.

9.If you think we have got this wrong

Write to info@kotorska54.com or to Kotorska 54, 51260 Crikvenica, Croatia. We will answer in writing within 15 days. If we cannot agree, an EU consumer may use the European Commission's online dispute resolution platform, and the Croatian courts have jurisdiction.

10.What this policy is not

It is not a penalty. Croatian and EU consumer law permit a trader to retain a genuine pre-estimate of loss and not a punishment, and the figures above are set against measured loss on a three-unit seasonal property rather than chosen to deter. §3 states the measurement it rests on, in the guest's own copy, deliberately.

11.Booking.com bookings

The policy there is set in Booking.com's own system and administered by them. It is not the policy above and is not changed by this page. Its terms, including any free-cancellation window, are shown during booking and in the confirmation.
